Financial services sector players and the = companies that=20 serve their needs have a long history of patenting technical=20 inventions.  Our = research=20 asked to what extent is the UK financial services = sector=20 aware of, or interested in, patenting business methods? As there = is no=20 robust definition of a business-method patent, we were interested = in any=20 patents that related to methods of doing business.  =

Questionnaires were issued to 134 financial = services=20 companies, addressed to the Company Secretary. 16% responded, = coming in=20 almost equal numbers from small and big players.  =

They indicated a low awareness of patenting as a=20 commercially significant issue. =20

  • 75% = had never=20 considered applying for a patent, 46% could give no reason why = not.  =
  • 58% = were unaware=20 that computer-implemented financial service products can be = patented in=20 the United=20 States.  =
  • 42% = believed=20 business method patents will not affect their operations over = the next=20 five years, whilst 53% were uncertain about the likelihood of = negative=20 impact. =20
  • 31% = felt that the=20 innovation gap between the United=20 States and the UK would=20 negatively impact on their business in the next 5 =96 10 years, = whilst 38%=20 did not know, and 31% felt it would not.  =
  • 58% = of=20 respondents confirmed that some form of innovative service or = product=20 was developed by their company in the last five years.  =
  • Innovation is=20 perceived as key in the sector, and patenting is acknowledged as = expensive, yet 56% were not certain whether there would be an = increase=20 in Research & Development budget in the next few=20 years.

UK companies are more averse to = patenting=20 than their US counterparts, and = financial=20 services companies appear to be more averse than other = sectors.  =

It can help in = some=20 limited cases, but if it=92s an important idea, you should file at = least=20 aUS provisional patent = application as soon as possible. =

Details: There is a common = misconception that if=20 you can prove that you are the original inventor of an invention, = then you=20 deserve to get a patent.  = This=20 is not necessarily true.=20

Patents are granted to inventors by national=20 governments in order to promote the welfare of their respective=20 nations.  The theory = behind=20 this is that the general welfare of given society will be improved = if=20 inventors are encouraged to publicly disclose critical aspects of = their=20 inventions that they would otherwise keep secret.  Patents provide = encouragement for=20 this public disclosure by granting limited monopoly rights to = inventors=20 for the new and non-obvious aspects of their inventions that they = describe=20 in their patent applications.=20

Generally, if an invention has already been = disclosed=20 to the public before a patent application is filed, then there is = no=20 longer any need for a government to provide any incentives to = redundantly=20 disclose the invention. =20 Whether or not an inventor can =93prove=94 that they were = the one that=20 made the original invention is irrelevant.  For almost every country = in the=20 world, an inventor is =93barred=94 from getting a patent once the = invention=20 becomes public.=20

The critical exception is the = United=20 States.  The United=20 States grants a one-year grace = period=20 from when an invention first becomes public to when an inventor = has to=20 file their patent application. =20 If, in the course of examination of a patent application, a = patent=20 examiner cites a reference that predates the filing date[2]=20 of said patent application by less than a year, then an inventor = may still=20 get a US patent if he or she can =93swear back of the publication = date=94[3]=20 of said reference.=20

In order to effectively swear back of a = reference, an=20 inventor submits a petition to the US patent=20 office along with written evidence to show that they fully = conceived of=20 the invention before the effective date of the reference and that = they=20 were =93diligent=94 in either =93reducing the invention to = practice=94 or filing a=20 patent application[4].=20

This is where the notarized document is = important.  A notarized document can = serve as=20 evidence of when an invention was first conceived.  A paper that is signed, = dated and=20 preferably witnessed can also serve as evidence.  A written = =93declaration=94 by a=20 witness can also be adequate evidence.  Similar evidence may be = used to=20 satisfy the diligence requirement. =20

It can be very difficult to demonstrate = diligence.  The inventor, for = example, must=20 work continuously on the invention.  If the inventor works on = another=20 invention before the first one is reduced to practice, that = destroys the=20 continuity and the inventor is deemed to not have been = sufficiently=20 diligent to be entitled to a patent. =20 Many other restrictions apply as well.   It is important to = consult a=20 licensed patent attorney or agent to get all of the=20 details.  =20

In summary, governments grant patents to = encourage=20 inventors to disclose the secrets behind their inventions.  If the secrets become = public=20 knowledge before a patent application is filed, then in most = countries of=20 the world, an inventor looses their patent rights.  An important exception = is the=20 United=20 States.  In the United States, an = inventor=20 can =93swear back of a reference=94 by submitting evidence that = they conceived=20 of the invention before the effective date of the reference and = were=20 diligent in either reducing the invention to practice or filing a = patent=20 application.  = Swearing back of=20 a reference can be very important in preserving an inventor=92s=20 US patent = rights, but=20 an inventor should still strive to file at least a = US=20 provisional patent application as soon as they have fully = conceived of=20 their invention.

Subclass 4 is used to identify claims in class = 705 which=20 are related to: Insurance (e.g., computer implemented system or = method=20 for writing insurance policy, processing insurance claim, = etc.).=20

Since our last = issue, 6 new=20 patents with claims in class 705/4 have been issued: 3 relate = primarily to=20 L&H and 3 are, primarily, P&C.  All but one has an = assignee=20 indicated. 

Patents are categorized based on their = claims.  Some of these newly = issued patents=20 may have only a slight link to insurance, therefore, based on only = one or=20 a small number of the claims made. =20

A=20 Better MouseTRAP?

Do you really = have a=20 better mousetrap =85 or, is what you have just invented more like = a mouse=20 feeding station?  = That is,=20 your brilliant idea, which you have developed into a patentable = machine,=20 is a humane way to get mice out of your house.  It attracts them out of = your house=20 through a one-way door to a feeding tray with some of the best = cheese and=20 peanut butter essence a mouse will ever find.

It works great = but is it a=20 mousetrap?  If there = were any=20 laws or regulations regarding prior approval of mousetrap=20 design before a better mousetrap=20 could be sold, you might have to embark on a long and difficult = process of=20 clearing a path to your door before you could sell it. 

Innovation in = the field of=20 insurance works the same way except there are laws and regulations = that=20 define what insurance is and isn=92t. =20 These laws and regulations won=92t, necessarily, affect = whether or=20 not you can get a patent on your idea but they may affect whether = or not=20 your insurance business method invention that defines a new type = of=20 insurance or a new and better approach to solving an insurance = problem=20 gets off the ground.

Defining Insurance=97The=20 Basics

Thinking=20 like an inventor, one would like to have as broad a definition of=20 insurance as possible that is not overly broad. That is, one wants = a=20 definition that captures the =93essence=94 of insurance and = nothing more.  The following definition = contains=20 all of the essential elements: =20

Insurance=20 is a process through which the financial consequences of a = contingent=20 event are transferred from one entity to another for the payment = of a=20 premium. =

This definition has all of = the=20 essential basic elements: a contingent (or insured) event; an = insurer; an=20 insured; and a premium.

 A contingent event is = an event=20 that is uncertain with respect to its occurrence, timing, = or=20 severity. That is, a contingent event is uncertain with respect to = any one=20 or more of these factors.  = The=20 uncertainty of the event occurring implies that the insured entity = generally has no control over the occurrence of the event, its = timing, or=20 its severity.  = Another word=20 used to describe this is: =93fortuitous=94.=20

 Uncertainty is an important = characteristic for=20 insurable contingent events. =20 The more certain an event is, the less insurable it is,=20 generally.  For = example, often=20 the financial consequences of pregnancy are insured although = =93pregnancy,=94=20 per se, is not considered an insurable event since it is not = really=20 uncertain with respect to its occurrence or timing.  However, since there is=20 uncertainty surrounding the severity of its financial = consequences,=20 insurance is more likely to be provided for complications resulting = from=20 pregnancy.  =20

 In=20 general, the uncertainty of an event implies that it is insurable = and that=20 insurance may be necessary in order to offset adverse financial=20 consequences.  This = is=20 supported by, for example, New York Insurance Law =A71101 = wherein it=20 states:


(1) =20 "Insurance =20 contract"  = means  any  agreement  or  other transaction = whereby one=20 party, the "insurer," is obligated to confer benefit of pecuniary = value=20 upon another party, the "insured" or "beneficiary," dependent upon = the=20 happening of a fortuitous event in which the  insured or beneficiary = has, or is=20 expected to have at the time of such happening, a material = interest which=20 will be adversely affected by the happening of such=20 event. =


(2)=20 "Fortuitous event" means any occurrence or failure to occur which = is, or=20 is assumed by the parties to be, to a substantial extent beyond = the=20 control of either party.

And, since = insurance law=20 and regulation tends to be reactive (perhaps much like law and = regulation,=20 in general), allowable and non-allowable types of insurance is = often=20 rather specifically defined. =20 For example, the statutes of most states recognize as = =93types of=20 insurance=94 the following broad categories: Life; Health; Property; Casualty;=20 Surety; Marine; and Title.   

An innovative = new =93kind of=20 insurance=94 might have some difficulty fitting in under these = broad=20 statutory categories and the more detailed subclasses provided for = in=20 law.  For example, = the=20 insurance of glass =93against loss or damage from any cause=94 is = a form of=20 casualty insurance anticipated under many state statues.  However, the insurance = of a sheet=20 plastic glass substitute like Plexiglas=AE, for example, is not = mentioned in=20 the law under =93kinds of insurance.=94 =20 This could be a problem =96 not for patentability but for = the=20 practical application of an invention that is designed to provide = a system=20 for insuring glass substitutes.

Consider the = development=20 of variable life and annuity products (VUL) that had their = beginnings in=20 the late 1960s but didn=92t find commercial success until the=20 mid-1980s. 

The VUL = product concept=20 serves as a good historical example that new product design can = stretch=20 the concept of what insurance is. =20 VUL, in particular, infused life and annuity insurance = products=20 with even more investment than they ever had before.  The pushing of the = investment=20 border in insurance products, lead to the addition of a = =93definition of=20 life insurance=94 to U.S. tax law=20 (IRC =A77702).  = This=20 definition marked, in tax law, the line between an annuity type=20 =93investment=94 and =93life insurance=94. =20 Insurance product innovators must now contend with this on = the life=20 insurance side of the business.

So, what is an = inventor to=20 do when faced with a non-accommodating regulatory structure?  That is a hard question = to answer=20 without the specifics but some general guidelines might be = applied.   
  =20  

  • First, insurance law and regulation = usually has=20 some miscellaneous or catchall category in which an inventive = new=20 product might fit into, at least, initially. 

For example, New York =A71113 in which = =93kinds of=20 insurance authorized=94 are defined has 31 paragraphs.  Paragraph 31 provides = such a=20 catchall category: 

(31)=20 "Substantially similar kind of insurance," means  such  insurance  which  in  the  opinion  of  the  superintendent  is  determined  to  be  substantially similar to = one of=20 the foregoing  = kinds  of  insurance  and  thereupon  for  the  purposes  of  this  chapter  shall  be deemed to be  included in that kind of = insurance.


If an invention enables a = =93substantially similar=20 kind of insurance=94 it may fit. =20 The inventor will probably have to make an effective = argument to=20 insurance departments to assert this point.

  • Maybe the product enabled by the = invention can be=20 modified to satisfy legal requirements or constraints without = doing too=20 much damage to the value of the inventive approach.   

For example, a new, inventive Long Term = Care=20 benefit structure designed to lower LTCi premium levels may not = comply=20 with all current state regulation regarding nursing home benefits = but can=20 be applied to care received at home. =20 This may not be ideal, but it is a start and, if = successful, may=20 prompt revision in the law to accommodate a broader application of = a=20 desirable new feature.

  • Each state independently regulates = insurance and=20 there are 50 states. =20 Although insurance law tends to follow general standards = applied=20 across state borders, some states may be more accommodating to a = particular inventive approach than others.  Progressive, for = example, found=20 that regulations governing county mutual insurance companies in = the=20 state of Texas[1] allowing them to have the first trial = of their=20 telematic auto insurance invention there in the late = 90=92s.  Identify the states = that have=20 the greatest need for your invention and start in those. =20
       
  • Remember, a primary purpose of state = insurance=20 regulation is to protect the interests of policyholders in the=20 state.  These = interests are=20 served if insurance companies are financially strong and the = products=20 they sell are fairly priced, not unfairly discriminatory, and = satisfy a=20 real insurance need.  = If an=20 inventive insurance concept is not contradictory to any of these = regulatory goals, it has a good chance of eventually being = accepted into=20 the insurance fold.     =20

A lesson to = take away from=20 this is that it is just as important to be aware of and begin = addressing=20 the regulatory approval aspects of any new approach to solving an=20 insurance problem as it is patentability issues.
